The creation of this subcommittee was approved by Council on 2 May 2012.

Terms of Reference

Definition of Property

In these Terms of Reference "property" is defined as real property, i.e. land and interests in land.  Includes things attached to the land, minerals in the land and interests that run with the land such as easements.

Functions

The Property Subcommittee shall have the following primary functions:

  • Making recommendations to Council on property acquisition policy and strategy;
  • Consideration of proposals to buy property, including proposals for compulsory acquisition of property under section 189 of the Local Government Act 2002.
  • Consideration of proposals to sell property, including proposals to sell or otherwise dispose of a park as set out in Section 138 of the Local Government Act 2002.
  • Hearing of submissions arising from consultation on proposals to sell or otherwise dispose of property under the Local Government Act 2002 or revoke reserve status under the Reserves Act 1977 as part of a proposal to sell such property.
  • Exercising the Council discretion under Section 79 Local Government Act 2002 in making judgements about how to achieve compliance with sections 77 and 78 Local Government Act 2002 in the sale and purchase of property.

Power to Act

The Property Subcommittee is delegated authority for the following matters:

  • Exercising the Council discretion (where applicable) under Section 79 Local Government Act 2002 in making judgements about how to achieve compliance with sections 77 and 78 Local Government Act 2002 in the sale and purchase of property.
  • Entering into agreements for purchase of property where such purchase has been provided for in the Council's Long Term Plan.
  • Entering into agreements for the sale of property where such sale has been authorised through the Council's Long Term Plan, or through compliance with any statutory requirements for such sale.
  • Making recommendations to Council on property acquisition policy and strategy.
  • Making recommendations to Council on entering into agreements for sale of property where such sale has not been provided for in the Council's Long Term Plan.
  • Making recommendations to the Council on entering into agreements for purchase of property where such purchase has not been provided for in the Council's Long Term Plan.
  • Making recommendations to Te Komiti on decisions on submissions arising from consultation on proposals to sell or otherwise dispose of property under the Local Government Act 2002 or revoke reserve status under the Reserves Act 1977.
