Plan Change 17 – Aotea Supermarket Zone

Progressive Enterprises Limited applied to rezone approximately 7,123 square metres of land currently zoned Suburban Zone at 3 Whitford Brown Avenue as part of a plan change request lodged with Porirua City Council on the 4th of December 2013.

The plan change request was accepted in March 2014 and Proposed Plan Change 17 was publicly notified in May 2014. 53 submissions and 1 further submission were received and were heard between September and October 2014.

The Hearing Panel’s recommended decision to approve Proposed Plan Change 17 with modifications, and to wholly or partly, uphold or reject respective aspects of the submissions, was adopted by the Council on 12 December 2014 and the applicant and submitters were notified of the decision at the same time. No appeals were received by the closing date for appeals on 16 February 2015.

The Council declared Plan Change 17 (Aotea Supermarket Zone) to operative on 8 April 2015. The Plan Change 17 provisions that have been made operative are reported in Attachment 1 to the Council Planners Report dated 3 March 2015 – available for download in the links below – Document Ref #1085470)

Amendments to Proposed Plan Change 16 (Network Utilities) pending operative date

Plan Change 17 includes some amendments to Proposed Plan Change 16 (Network Utilities) – the purpose of which was to include references to the ‘Aotea Supermarket Zone’ in Proposed Plan Change 16.

Proposed Plan Change 16 had not reached the stage of a decision by the time of making Plan Change 17 operative, therefore the Council has decided not to make the amendments to Proposed Plan Change 16 (that were part of Proposed Plan Change 17) operative yet. These amendments are reported in Attachment 2 to the Council Planners Report dated 3 March 2015 – available for download in the links below – Document Ref #1085871). An operative date for these amendments will be determined when Plan Change 16 is ready to be made operative. In the interim, any proposal for network utilities within the Aotea Supermarket Zone can be considered by way of resource consent application.
