Background to Bylaws

Parliament makes statutes (Acts) and regulations which are applicable and enforceable throughout New Zealand.

Local authorities (eg a City or District Council) are empowered by the Local Government Act 2002 to make bylaws and schedules which apply only within the territorial district of the authority making it.

In comparison to a statute and regulation a bylaw is the local equivalent of a statute while a schedule equates with a regulation.

Bylaws cannot over rule or otherwise counter the purpose and effect of a statute or regulation.

Bylaws and schedules are made by formal resolution of Council following the completion of a Special Consultative Procedure process required by the Local Government Act 2002 to enable public input into the bylaw in each case by commenting on or making submissions supporting or opposing the proposed bylaw or recommending modification to it.

Councils are required by the Local Government Act 2002 to review their bylaws on a five yearly basis using the Special Consultative Procedure to ensure they remain current and relevant in our changing environment.

Porirua City Council General Bylaw 1991

Council's current regulatory bylaw is the Porirua City Council General Bylaw 1991. It is a consolidation of the original 1991 bylaws and bylaws that have been deleted, amended or added since 1991.

Current Bylaws

Police enforce the bylaw using special powers provided by Sections 169 and 170 of the Local Government Act 2002.
